One of the most frustrating things for me as an Austin criminal defense lawyer is a client who does not take their criminal case serious or at least as seriously as they should. One of the most common questions that I receive is “what is the fine for a marijuana ticket?” It is important to understand that a possession of marijuana ticket, at least in Texas, carries jail time and carries more penalties than just a fine. An important point I try to make with clients or potential clients who have been been issued a ticket for possession of marijuana, is that they need to take their case just as seriously as if they had been arrested. I think the unfortunate experience of spending the day or night (or several of them) in the Travis County Jail leaves a lasting impression on those who have been arrested, or at least it should.

There are many views on whether marijuana should be legal in Texas, but for now, it is illegal. Fortunately, Travis County does have a “cite and release program” where a citation can be issued with a promise to appear, usually to Travis County Justice of the Peace Court #5. It is at this appearance that a defendant will then go through the booking process, just like anyone else who is arrested in Austin. After the booking process, the defedant will be given an initial appearance date where they will have to come back to court. The case is now at the same point in the criminal process as a possession of marijuana case that began after an arrest at the time of the incident.
